Agreement to Terms

By downloading, installing, or using the Vytal application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

Description of Service

Vytal is a health monitoring application that:

• Collects physiological and behavioral data from your Apple Watch and iPhone
• Analyzes your data using on-device AI (Core ML) and optional cloud-based AI
• Provides personalized health insights and recommendations
• Offers graduated, non-intrusive interventions when needed
• Generates reports that can be shared with healthcare professionals

Eligibility and Requirements

To use Vytal, you must:

• Be at least 18 years old (or have parental consent if under 18)
• Own an iPhone and Apple Watch compatible with the App
• Have the latest version of iOS installed
• Grant necessary permissions for HealthKit, DeviceActivity, and Calendar access
• Agree to these Terms and our Privacy Policy

IMPORTANT: Vytal is not a medical device and does not provide medical advice, diagnosis, or treatment. The App is designed for informational and wellness purposes only.

You acknowledge and agree that:

• Vytal is not a substitute for professional medical advice, diagnosis, or treatment
• You should always seek the advice of qualified health providers with any questions regarding a medical condition
• Never disregard professional medical advice or delay seeking it because of information provided by Vytal
• If you have a medical emergency, call your doctor or emergency services immediately
• The Sync Score and other metrics are wellness indicators, not medical diagnoses

User Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account and device
• Ensuring your Apple Watch and iPhone are properly configured and functioning
• Providing accurate information when using the App
• Using the App in accordance with these Terms and applicable laws
• Not using the App for any illegal or unauthorized purpose
• Not attempting to reverse engineer, decompile, or hack the App

Intellectual Property

The Vytal App, including its design, features, AI models, and content, is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

Limitation of Liability

To the maximum extent permitted by law:

• Vytal is provided "as is" without warranties of any kind
• We do not guarantee that the App will be error-free or uninterrupted
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the App (if any)
• We are not responsible for decisions made based on App data or insights

Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause, with or without notice, for any reason including, but not limited to, breach of these Terms.

You may stop using the App at any time by uninstalling it from your device.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
